Please read these Terms and Conditions (“Terms”) carefully before using the Found Loop website and services (collectively, the “Service”). These Terms govern your access to and use of the Service provided by Found Loop (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.

1. Acceptance of Terms

By using the Found Loop Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. These Terms constitute a legally binding agreement between you and Found Loop.

2. About Found Loop

Found Loop is a service designed to assist individuals in recovering lost items and returning found items. We achieve this by collecting detailed information about both lost and found items, performing matching processes, and, with your consent, proactively making inquiries on your behalf and sending targeted alerts to relevant organisations and other potential finders or owners (including our network of partner venues and businesses) to significantly increase the chances of an item being located and successfully reunited.

3. Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Your Account (if applicable)

While direct account creation may not be required for listing items, if Found Loop introduces features requiring registration, the following will apply:

  • You are responsible for maintaining the confidentiality of any login credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorised use of your account.

5. Your Responsibilities and Information Provided

When using Found Loop, you agree to:

For all items(lost or found):

  • Provide accurate information: You are solely responsible for ensuring that all information you provide regarding your lost or found item (description, location, timing, photos, contact details) is accurate, complete, and truthful. Inaccurate information may hinder the matching and recovery/ reunification process.
  • Consent to communication: You consent to Found Loop contacting you via the provided email and phone number regarding the status of your item or a potential match.
  • No misuse: You will not use the Service for any unlawful, fraudulent, or malicious purpose, including reporting non-existent items or providing false information.
  • Compliance with laws: You agree to comply with all applicable local, state, national, and international laws and regulations when using the Service.
  • Acknowledgement of partner involvement: You understand that Found Loop may collaborate with external partners (e.g., venues) to gather and process information about found items, and that your item information may be shared with such partners as necessary to facilitate reunification, as outlined in our Privacy Policy.

Specifically for people who tell us about lost items:

  • Consent to inquiries and alerts: By providing your information and consent regarding a lost item, you explicitly authorise Found Loop to make inquiries on your behalf and send alerts containing details of your lost item to organisations, venues, and other relevant third parties not directly associated with us, for the sole purpose of assisting in the recovery of your lost item.
  • Item ownership: You represent that you are the rightful owner of the lost item you are telling us about.

Specifically for people who tell us about found items:

  • Consent to reunification efforts: By providing your information as someone who has found an item, you explicitly authorise Found Loop to use your information to facilitate the reunification of the item you found with its rightful owner.
  • Consent to share found location for pickup (optional): If you consent, you authorise Found Loop to share the general location where the item was found with the verified owner to facilitate direct pickup. You understand that this is optional and your personal contact details will not be shared without separate consent.
  • Honest reporting: You commit to reporting found items in good faith and with the intention of seeing them returned to their owner.
  • Temporary custody: You acknowledge that by telling us about a found item, you may temporarily be in custody of the item. Found Loop is not responsible for the physical security or condition of the item while in your possession. You agree to exercise reasonable care regarding the found item until it is returned to its owner or handed over to your local Police station.

6. Our role and limitations of Service

  • Facilitation, Not Guarantee: Found Loop acts as a facilitator to connect individuals with lost items to potential finders or organisations that may have found them, and to connect finders with lost item owners. We do not guarantee that your lost item will be found or returned, nor do we guarantee a found item will be claimed. Our Service increases the chances of recovery and reunification but cannot assure success.
  • Proactive engagement and information sharing: While we take reasonable steps to protect your privacy (as outlined in our Privacy Policy), you acknowledge that by consenting to our service, certain details about your lost or found item and limited contact information (for Found Loop to be contacted) will be shared with third-party organisations when we make inquiries or send alerts on behalf of people who list lost items.
  • Intermediary role for reunification: For found items, including those reported by our partners, Found Loop will act as an intermediary. We will not directly share the personal contact information (e.g., email, phone number) of a lost item owner with people and organisations that find items (including partners), or vice versa, without explicit, separate consent from both parties. All initial communications regarding a match will be facilitated through Found Loop.
  • No physical possession: Found Loop does not take physical possession of lost or found items as part of its standard service. Our service is based on information matching, proactive inquiries, and communication.
  • Item condition & custody: We are not responsible for the condition of an item upon its return, or for any damage or loss that occurs during the recovery or shipping process by third parties or while the item is in the custody of a finder.
  • No financial responsibility: Found Loop is not responsible for any costs, fees, or expenses you may incur in connection with the recovery or return of an item, including but not limited to shipping costs (unless explicitly agreed upon by Found Loop), travel expenses, or rewards offered.

6A. Our Partnership Network

  • Collaboration with Partners: Found Loop actively collaborates with a network of external organisations such as venues, public transport companies, and event organisers (“Partners”) who may find lost items on their premises. Our Service facilitates the listing of these found items by Partners into our system.
  • Information exchange with Partners: You acknowledge that when a Partner lists a found item with us, details of that item will be included in our database. Similarly, if your lost item matches an item listed by a Partner, we will share relevant details of your lost item listing with that Partner to facilitate verification and reunification.
  • Partner responsibilities: While we partner with reputable organisations, Found Loop is not responsible for the internal handling procedures, storage, or security of items by our Partners. Any claims regarding the physical custody or condition of an item held by a Partner must be directed to that specific Partner.
  • Facilitating Partner returns: Our role in relation to partner-listed items is to facilitate the connection between the owner and the Partner. The specific process for retrieving an item from a Partner (e.g., pickup arrangements, identification requirements) may be governed by the Partner’s own policies and procedures.

7. Item return and shipping

  • If an item is found and matched, and requires shipping for its return, we will collect the necessary postal address solely for this purpose.
  • You acknowledge that we may share the postal address with trusted third-party shipping or courier services to facilitate the delivery of the item. These services will handle your data in accordance with their own privacy policies.
  • Any costs associated with shipping the recovered item will be communicated and must be agreed upon by the relevant party (owner or finder) before shipping commences. Found Loop is not obligated to cover these shipping costs unless otherwise expressly agreed.

8. Intellectual Property

All content, trademarks, service marks, logos, and other intellectual property on the Found Loop website and Service are owned by or licensed to Found Loop. You may not use, reproduce, distribute, or create derivative works from any content without our express written permission.

9. Disclaimers and Limitation of Liability

  • Service “As Is”: The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Warranties: Found Loop does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
  • Limitation of Liability: To the maximum extent permitted by law, Found Loop, its directors, employees, partners, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
    • Your access to or use of or inability to access or use the Service;
    • Any conduct or content of any third party on the Service;
    • Any content obtained from the Service; and
    • Unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
  • Australian Consumer Law: Nothing in these Terms limits any rights you may have under the Australian Consumer Law (ACL) which cannot be excluded. To the extent that the ACL applies, our liability for breach of any consumer guarantee is limited to (at our option):
    • The supplying of the services again; or
    • The payment of the cost of having the services supplied again.

10. Indemnification

You agree to indemnify, defend, and hold harmless Found Loop and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Queensland, Australia, to resolve any dispute arising out of these Terms or the Service.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Found Loop regarding our Service and supersede and replace any prior agreements, oral or otherwise, regarding the Service.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
